Terms and Conditions

1. Scope

These terms and conditions apply to all purchases of artworks that you make through this website from Olaf Hoppe, HAUS HOPPE – Galerie für Bildende Kunst (hereinafter “we”).

2. Contracting party

The contract of sale is concluded with Olaf Hoppe, Zum Breitling 12, 23974 Boiensdorf OT Stove, Germany.

3. Offer and conclusion of contract

The presentation of works on this website does not constitute a legally binding offer, but a non-binding invitation to order a work. By completing the payment process via PayPal, you submit a binding offer to purchase the respective work.

The contract of sale is concluded only upon shipment of the goods. Immediately after your order you receive an email confirming that we have received your order (acknowledgement of receipt). This acknowledgement does not yet constitute acceptance of your offer. A contract of sale is concluded only when we ship the goods and confirm the shipment.

Each work is a unique piece or available in a limited edition. If an ordered work is no longer available, no contract is concluded; any payment already made will be refunded to you in full without undue delay.

4. Prices and shipping costs

All prices are final prices and include statutory VAT (reduced rate of 7% for works of art supplied by their creator). Shipping within Germany is free of charge.

5. Payment

Payment is made via PayPal, optionally also by credit or debit card and other payment methods offered by PayPal. The purchase price is due upon completion of the payment process.

6. Delivery

We deliver to the shipping address provided by PayPal. If no contract is concluded because no shipment takes place, any payment already made will be refunded in full.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. For details and requirements, please see our right of withdrawal.

8. Retention of title

The delivered goods remain our property until full payment has been received.

9. Warranty

The statutory rights in respect of defects apply. Variations in colour and texture that are inherent in original prints (woodcuts) for technical printing reasons do not constitute a defect, provided they are within the usual range.

10. Liability

The statutory liability provisions apply.

11. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
